Sir/madam TAHRIR ( Transparency, Accountability & Human Rights initiative for revolution ) is a Bareilly/Lucknow based Social Organization, working at grass-root level by taking up & solving issues related to strengthening transparency & accountability in public life and protection of Human Rights in India. We are now writing to express our grave concern regarding the criminal intimidation, insult, annoyance to Aakash Agrawal and his father Ashok Kumar Agrawal of Gonda District of UP by Vinod Singh alias Pandit Singh, a minister in UP State’s Government from his mobile no. 9984393000 and with the help of Nitesh Singh and Shivpati Singh on their mobiles, both said to be employees of Uttar Pradesh Police Department for posting a news-clip on social media website facebook by Aakash Agrawal. Weblinks given below. http://www.4pm.co.in/archives/ http://bhadas4media.com/ The Victim: Aakash Agrawal and his father Ashok Kumar Agrawal of Gonda District of Uttar Pradesh India & his family. The Perpetrators: Vinod Singh alias Pandit Singh, a minister in UP State’s Government with the help of Nitesh Singh and Shivpati Singh, both said to be employees of Uttar Pradesh Police Department. Date of Incident: 23rd of May, 2015 Place of Incident: Gonda District of the Northern Indian State of Uttar Pradesh. Incident detail: According to the sources, a Minister of Uttar Pradesh Government named Vinod Singh alias Pandit Singh got so much annoyed by Aakash Agrawal’s posting a news on social media site facebook that the minister rang him from mobile no. 9984393000 and while using unparliamentarily & filthy language, gave him life threats. According to media reports Pandit Singh Used language which was also insulting to the modesty of Sister & mother of the victim. This way, apart from criminal intimidation and insult to modesty of women members of victim’s family, Human Rights of Victim’s whole family have been grossly violated by the Minister and the policemen. Appeal : We, therefore urge you to immediately take necessary steps to ensure that •The minister is immediately suspended from ministerial berth and a formal inquiry be instituted against him by Uttar Pradesh Government. •The Superintendent of Police and the District Collector and District Magistrate of Gonda and Lucknow should ensure immediate registration of FIR against the minister and his aides and an immediate, thorough, transparent, effective and impartial time-bound investigation be done into the above-mentioned event. • Take immediate action on the perpetrators for criminal intimidation, insult to modesty of women & life threats to victim and his family. • Guarantee in all circumstances the physical and psychological integrity of Victim and his family members who are still under risk of further attacks from the perpetrators. • Ensure provision of reparation, compensation, apology to the defenders for the physical and psychological sufferings they underwent because of the criminal acts of Minister and provide a re-assurance of not engaging in such acts against the victim; • Put an end to all acts of criminal intimidation against all victims in the State of Uttar Pradesh to ensure that in all circumstances they exercise their constitutional right of freedom of expression without any hindrances; • Takes steps to conform to the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially: - Article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels - Article 12.2, which provides that “"the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”; • More generally, ensures in all circumstances the respect for human rights and fundamental freedoms in accordance with in accordance with the Universal Declaration of Human Rights and with international human rights instruments ratified by India.
