Sub.: Request to issue immediate directions to MHA for taking
immediate action in pending case of sanction request for prosecution
of Sada Kant Shukla,IAS( The then Jt. Secretary,MHA) presently working
as Principal Secretary ( Housing & Urban Development ) in Uttar
Pradesh Government.

Sir,
This refers to crime number RC-11(A)/2010,ACB,Dehradun in which
sanction was solicited/proposed on 09/11/2012 but even after almost 4
years time period, Ministry of Home Affairs has not been able to take
decision on CBI’s request of sanction for prosecution, a decision MHA
should have taken within 3 months. All this because the accused IAS
Sada Kant Shukla (then Joint Secretary, MHA and now Principal
Secretary of Housing & Urban Development department of Govt. of U.P.)
is said to have very excellent rapport and relations with the Hon’ble
Home Minister Raj Nath Singh of your government. This is noteworthy to
mention that your government is sleeping on this case of corruption,
that too a case in which corruption was  done at the cost of safety &
security of ‘BHARAT MATA’ i.e. INDIA. IAS  Sada Kant Shukla is accused
of taking bribe of more than 200 Crores on projects of  construction
of roads on borders of India i.e. BHARATMATA. Isn’t it enough to prove
hypocrisy on the part of your Government?

I am writing to you forth time in this matter. This is the basic
principal of physics that everything on earth, moves from top to
bottom on its own due to gravitational pull; so is the case with
‘CORRUPTION in public life’, which is swiftly making its way from Top
to Bottom on its own.

Sir, in our homes, we always avoid keeping dangerous things at high
positions lest they should fall and cause harm to us; then how come we
are continuously keeping officers like Sada Kant Shukla,  accused of
corruption, posted at top positions who are surely causing much more
harm to the system than ever expected. Moreover, do you personally
feel that officer like Sada Kant Shukla, accused of corruption
possesses  morale and courage  to contain corruption under him? Is it
justified to keep Sada Kant Shukla active in public life despite he
being accused of the most heinous crime of earth i.e. corruption?


You must be aware that a committee headed by Sri Pranab Mukherjee had
earlier recommended that the permission for prosecution should be
given within three months. Much before, in Vineet Narain & Ors. Vs.
Union of India (AIR 1998 SC 889) case, the Apex Court had laid down to
strictly adhere to the time limit of 3 months for grant or otherwise
of sanction for prosecution on requests received from CBI/other
investigating agencies. Hon’ble Supreme Court of India has also ruled
that Central Bureau of Investigation does not need prior sanction to
initiate inquiries against senior government officials (joint
secretary and above).

Sir, You had promised INDIA that you shall deal with the corruption
cases strictly without caring about the allegiances of the accused.
You had promised all of us to set up special courts for speedy trials
for disposal of corruption cases against politicians and corrupt
bureaucrats. But it seems that you only made false promises to whole
of India with a shrewd intent to grab power by befooling the whole
country.

Sir, Prosecution is only a part of  process of law and in no way it
means  punishment. Accused Sada Kant Shukla should not be spared only
because of his high position and his close relations with politicians
of various political parties including yours BJP, other high placed
persons and money earned by corruption in his life. If path of the law
shall be blocked for years as is happening in this case, India shall
never be able to contain corruption. I am of firm belief that Sada
Kant Shukla is expediting his links in your party and government to
ensure he somehow retire and till then let the matter remain in
hibernation and this is one of the reasons of this unexplained
pendency of almost 4 years.

Sir, I personally have full faith in your ( Narendra Modi’s ) ability
to fight against corruption so now government led by you has an
immediate task to get this case of sanction request for prosecution of
 Sada Kant Shukla, accused of corruption, decided immediately as this
case is almost 4 years old.

So I am requesting you to issue immediate directions to MHA for taking
immediate action in pending case of sanction request for prosecution
of Sada Kant Shukla,IAS( The then Jt. Secretary,MHA) presently working
as Principal Secretary ( Housing & Urban Development ) in Uttar
Pradesh Government.

With lots of expectations.
