Sir, On 31st December 2014, while addressing a press conference to recount the achievements of the Samajwadi Party government during 2014, UP CM Akhilesh Yadav admitted that he saw the film ‘PK’ on Tuesday ( 30th December 2014 ) night. He also said, "People had been telling me for many days to watch PK. I downloaded it a few days ago, but only found the time to watch it last night. I liked it immediately and decided to make it 'tax-free' so that more people can watch it.” So It becomes an established fact that Uttar Pradesh Chief Minister Akhilesh Yadav illegally downloaded the film ‘PK’ from a website named ‘Torrent’ and watched a pirated copy of film. A copyright violation under Section 63 of the Copyright Act, 1957 (the Act) read with Copyright (Amendment) Act, 1994 (38 of 1994) , is a cognizable criminal offence where, upon complaint, police should take legal action. Under section 64 of the Copyright Act, 1957, police has power seize infringing copies. As per Section. 65,any person who knowingly makes, or has in his possession, any plate for the purpose of making infringing copies of any work in which Copyright subsists is punishable with imprisonment which may extends to 2 yrs. and with fine. In view of the unequivocal provisions contained under Section 69 of the Act, all persons responsible for such conduct are liable for imprisonment and fine. Infringing Copy is any reproduction, copy or sound recording, as the case may be, made or reported in contravention of the provision of the Act. The offence besides being punishable under IT Act 2000,is punishable under 1923 Goondas Act also. Keeping in view the responsible position of CM, held by Akhilesh Yadav, its clear that he was fully aware of the fact that his conduct was not only illegal but was a criminal act also but even then, he not only committed it but by misusing the high position of CM, dared to announce it in broad daylight in a press conference. Sir, Hackers are persons who view confidential information, steal trade secrets or intellectual property with the use of internet. Hackers are also involved in intellectual property crime, forgery, unauthorized access to Computer system, theft of information contained in the electronic form. Going by this Akhilesh Yadav has also acted like a hacker in this matter. On the basis of abovementioned facts, I, as a responsible citizen of India, am requesting you to get the matter of downloading the film ‘PK’ from a website and thus watching a pirated copy of film by UP Chief Minister Akhilesh Yadav and others inquired thoroughly. Please take subsequent punitive actions including registration of First Information Report (FIR) against all the defaulters as per prevailing law of the land. Regards.
