Complaint to initiate inquiry and take punitive action against the
perpetrator Lady IAS officers.

Sir/madam
TAHRIR ( Transparency, Accountability & Human Rights initiative for
revolution ) is a Bareilly/Lucknow based Social Organization, working
at grass-root level by taking up & solving issues related to
strengthening transparency & accountability in public life and
protection of Human Rights in India.
We are now writing to express our grave concern regarding two cases of
harassment and gross violations of human rights of two persons by
utter misuse of power by two lady IAS officers of Uttar Pradesh.
We have come to know through newspapers that a gardener employed at
the state-run Pandit Govind Ballabh Pant park in Gorakhpur has claimed
that he had to go jail for “disobeying” SDM (Sadar) Neha Prakash when
she asked him to stop cutting grass at the park as she was allergic to
it. Neha, on her part, said that she had complained to the police
against Yadav.Vishwanath Yadav, who was arrested and booked under
Section 151 of the Indian Penal Code (disturbing public peace), was
released later by city magistrate Satish Pal on two sureties of Rs 1
lakh each.Speaking to mediapersons after walking out of the jail,
Yadav said the incident took place early morning on Tuesday when he
was cutting grass and the SDM was taking a walk in the park. “She
asked me not to cut the grass as she was allergic to it. Once she was
a good distance away, I started cutting the grass again. This angered
her and she threatened me.”Though Neha, on her part, claimed that she
had played no role in Yadav’s arrest.“Everyday, I go to the park for
yoga. On Tuesday too, I was practising yoga when the gardener started
cutting the grass. I asked him to stop as it was spewing dust, but he
didn’t listen.”She added that other women in the park had told her
that Yadav misbehaved with them and made obscene gestures. Neha,
however, reiterated that she had not complained to the the police
against Yadav.Following Yadav’s release, Gorakhpur Commissioner Rakesh
Kumar Ojha said: “Whatever the matter was has now been resolved.”
In another incident, SDM Allahabad Trainee IAS Harshita Mathur got
Sunil Chaudhary arrested for allegedly his taking a selfie pic with
SDM while handing over a Memorandum for removal of a Red Light Areas
to her.

Such type of autocratic behavior by public servants with their masters
( public ) is highly objectionable and cannot be taken for granted
lest it becomes a routine and leads to a situation of complete
wreckage of constitutional rights of citizen UP.
We are bringing forth these cases where freedom of expression, general
laws & humanitarian law are under attack in UP. This is a case where
authorities have harassed and intimidated citizens. That, these two
IAS have arbitrarily got the two citizen arrested by invoking CrPC
151,this kind of intimidation leads to massive censorship on freedom
of expression, general laws & humanitarian law and when freedom of
expression, general laws & humanitarian law are suppressed, the
people’s constitutional right to dignified life is grossly violated.
Government of Uttar Pradesh has been slow to address many areas of
concern in humanitarian sphere, and has demonstrated what appears to
be a more hard-line attitude in some areas such as restrictions on
freedom of expression. There is a worsening pattern from 2012 to 2015
of harassment, intimidation and target threats against citizen and
human rights
defenders, many of whom have been forced to exile .
We are requesting you to take appropriate actions to ensure that the
government of Uttar Pradesh should establish a transparent regime of
working in public life and ensure encouragement protection of Human
Rights of its citizen and Human Rights defenders with no more
humiliation to them at all. We are also requesting your good-self to
look into these two particular cases of harassment and gross
violations of human rights of two persons by utter misuse of power by
two lady IAS officers of Uttar Pradesh and to initiate inquiry and
take subsequent punitive action against the said perpetrator as per
the law of the land.
